to talk about some changes he wants in california's drug laws. >> obvious, a preview of super tuesday, the day that the republican presidential candidate has been waiting for. things are still up in the air when you have to talk about that. >> we'll have the chairman still here with us. the search for survivors is continuing today after a string of tornadoes hit the midwest and south. the >> the number of people killed have flaunted to 35 people in five states. a pair of tornadoes destroyed the town of harryville, indiana. we'll have a live report from that scene in about five minutes. more than 10,000 college students will rally at the state capitol tomorrow. they held occupy education events on thursday. they are upset about having to pay more money for higher education while more faculty and staff members are being laid off. students want governor brown to reject any budget deal that includes education cut or

tuition hikes. they also support raising funds with proposed tax hikes on the rich. now on to national headlines, we'll turn to our campaign 2012 coverage. mitt romney has won the caucuses in the state of washington, but not by the majority, providing questions for you. more questions about the momentum as he heads into super tuesday in about 48 hours from now. with the vote in all precincts now counted, romney has 38%. ron paul is second in washington with 25% and rick santorum is a close third with 24%. while newt gingrich is further back with 10%. now this weekend, romney has been highlighting his business background. >> with jobs so badly needed, incomes having gone down, we need a president who knows the economy to fix the economy. >> romney is in a close battle with santorum in ohio. romney said late last night that his win in washington state means voters, "do not want a washington insider in

the white house." by the way, they call these two presidential hopefuls the spoilers. newt gingrich and ron paul joined him on face the nation this morning. according to bob, the race may still be wide open after super tuesday thanks to these other candidates. that's on face the nation starting at 8:30 right here on cbs5. announcing the views on women and politicians. the conservative radio personality apologized for insults directed at a young woman who testified before congress about birth control coverage. don knapp reports one of those outraged by his comments were a bay area lawmaker. >> reporter: the excepts were extremely harsh and shocking. now he acknowledges that he went too far when he called a georgetown university law student a word and a prostitute. he issued an apology saying, "my choice of words were not the best and the attempt to be

humorous, i created a national stir. i sincerely apologize to ms fluke for the insulting word choices." the student was asked to testify at the congressional democrats in support of their health care policy that would require her college to cover her birth control. it in responding to that testimony, what does it say about the college co-ed who goes before the congressional committee and essentially says that she must be paid to have sex, right? she must be paid to have sex. the congresswoman fired back from the floor of the house. >> shame on you for being the hate monitor that you are. shame on you. shame on you for calling the women of this country prostitutes. >> they first started national attention two weeks ago when they refused to let her testify before the all-male panel hearing testimony on the obama administration's new policy of the insurance coverage for the

contraception. before she heard from him, fluke got a call from the president. >> he also just wanted to express a concern and make sure that i was okay. he mentioned that as a parent of two daughters, he hopes that i would tell my parents that they should be proud of me. >> reporter: don knapp, cbs5. both republicans and democrats had condemned his remarks and despite his apologies, sponsors have pulled ads from his radio show. well today rescue workers are using search dogs as they look for the tornadoes that smashed many parts of the south in the midwest. >> yeah, friday storms in at least 38 states, they killed 38 people in five states and hundreds more people are injured rather that way. >> harriesville, indiana, where -- we are in indiana where the tornadoes touched down. >> reporter: it was a confirmed tornado that did move through here and based on the destruction, not much of a

doubt about that. more importantly, we know how strong that tornado was. an ef4, second most strongest tornado on a scale from 0 to 5, it was a 4. search and rescue efforts are continuing this morning and they are underway, searching for those who might be trapped, injured, or maybe dead. new video shows the tornado plowing through southern indiana on friday. the national weather service determined two tornadoes hit the town. one rated an ef4. packing winds of up to 175 miles per hour. >> it is definitely on the ground now. and they were very scared. >> reporter: she was with her father, a bus driver for the town and the school district. he left this school on friday afternoon with the bus full of kids, trying to get them all home before the storm came. but he ran out of time with a couple of kids still on board and made that decision to seek the shelter in the church basement, possibly saving their

lives. >> two to three minutes it hit and it went right over the top of the church. we watched it through the windows. out at the church basement. it was close. >> reporter: the national weather service said that the tornado that measured about 150 yards across, they were on the ground for the astonishing 52 minutes that left mind the power lines down. >> reporter: it leveled homes, overturned trucks for survivors. a 20-month-old girl named angel babcock was found alive. but now she is an orphan. >> i don't want to believe. >> reporter: friends andfamilies are grieving the loss of her parents. their two-month-ole daughter -- old daughter and 2-year-old son. >> it is very hard for all of them. >> reporter: she is in critical condition on life support out at the louisville hospital. >> reporter: it's still one of

those amazing stories that comes out of this. as many others again, that 2- year-old on life support in a kentucky hospital and people are pulling for her this morning. >> i've got to ask you, what is with the bus behind you? it's amazing. did it just get picked up and thrown through into that house? >> reporter: yeah, you know, the thing is when these tornadoes move through, we talked about it. this doesn't make any sense. what you see over here to the left, that's the bus, the gas tank right there. that's typically under the bus. the frame of the bus over here was thrown into that cafe. so somehow when the tornado came through, the frame of the bus itself were ripped apart, flew across the treat and then into this cafe, guys. >> wow. that's absolutely incredible power. >> all right, terrell brown live for us. a proposal to change drug

cause of this apartment fire in san francisco. it started he more bay area headlines now. searching for the cause of this apartment fire in san francisco last night. it started just after 9:30 in the bay view area as you can see a lot of flames are there and dozens of people are now out of their homes. the red cross is helping 21 adults and seven children find temporary places to live. bart is looking for your input on the inevitable. the fare increases before

making a price hike in july. bart is holding five public workshops this month and doing an online survey to give you ideas. the point is to figure out how to spread that among differentriders. the owner of the oakland a's are dismissing the report that the team will not be allowed to move to san jose. the columnist writes that he is likely to uphold the giant's territorial report. they will not overvote to turn on the giants rights. they are a friend of his and they said that he did not bring up that issue during the conversation he had yesterday. well, will we see temperatures warm up in the bay area? >> yesterday was gorgeous and it looks like today will be a repeat, taking a live look outside right now. and it really feels like spring on out there. right now, that's when we'll see a cool down for you and in today's pinpoint forecast. good morning, well, we are

off to a clear start this morning and then by this afternoon, the temperatures, they really going to warm up. we'll see the widespread 70s all across the bay and your weather headlines, you have seen cooler days just ahead. it looks like for the start of the workweek, they will take a slight nose dive. so now the weather today if you liked yesterday, you're really going to like today as well. it is holding steady and bringing us some pretty nice mild conditions and dry weather. so your future cast kind of tells the story over the next 72 hours. we're going to see a pretty clear sky until monday evening into tuesday. you'll see that's when things start to get a little unsettled. now, any rain we do get, it will be very light sprinkles. it's going to be mainly north of the golden gate and the north bay and then anything we do get, it will with with completely on out of -- it will be completely on out of here. for today, pinpoint forecast is showing beautiful skies, plenty of sunshine all across northern california. we know a lot of folks are hitting the roads up if many

tahoe. 54 is your high there. plenty of sunshine, mostly sunny skies in sacramento. the winds are higher in the upper 70s in places like fresno. if you're doing any traveling today, not too bad. and your pinpoint forecast, bringing you closer to home. we'll see the real great temperatures, reaching the upper 70s in some spots. check out these temperatures in the south bay. campbell at 79. 74 is your forecasted high in places like hayward and the east bay. other east bay numbers, 74 in brentwood, 75 out in pleasant hills and places like vallejo. not too bad. none of these will be record breakers, but the temperatures are about 10 to 15 degrees above average for this time of the year. 73 in kentfield and 70 degrees is your forecasted high for you in the valleys. so now once again, the weather repeat today and from what you saw yesterday. another great day to get on out and enjoy this beautiful winter for you if you can believe it. the temperatures.

of the nine-circuit judges. we expect that it could go again and it could be limited to just california. one way or the other, the public opinion is moving on in and that it is yet to be a successful view to them and any court of law as to why denying these marriage licenses will be good for them. they need a compelling reason. are you going to two back through that this year? >> no, definitely not. >> why not? >> there is not the money, why would you interfere with all the successful runs that you having have right now in the polls. do you trust the polls? they are always plus or minus and they are 3%. the trend is over 30 years, it's incredible. it's interesting to note that it is not just among the democrats and the republicans. even the republicans over 65, they are moving in the direction of equality. >> is there a concern that you might say one thing to them and the polls? >> we always figured a few percentage points. >> meanwhile you don't want that no vote here in california? >> right.

>> they don't leave. >> correction. speaking of courts, you have introduced that rather interesting bill in the state senate. and you want to basically take possession of the drugs and change it from the felony through the misdemeanor. >> that's correct. >> okay, why? >> well, 13 other states already do. and the hot beds of the revolutions as well such as west virginia, tennessee, mississippi. and wyoming, iowa, they all do it. now, we would save about $160 million at the county levels each year. along with another $65 million of the state general fund. and the benefit for them, where we could put that money into the drug treatments. states that have misdemeanor laws rather than felony laws have lower rates of drug use and higher rates of drug treatment. these felonies don't keep us any safer and they don't persuade anyone not to use drugs. what they do is set up barriers for them to the education housing, the employments. the very three things that will

keep a user's life stable so they will not reuse it. >> i'll tell you that law enforcement people will say look, it takes a lot of repeat offenses to wind up in the state prison for the drugs these days. they don't just grab you off the streets. you know, off times it does include the earlier drug treatment programs that you fail. finally they will say okay you're going away. in the process, you know, there's a lot of burglaries, a lot of other things that are going on, associated with the drug use. and they have allowed them to be misdemeanors. >> i'm glad you bring that up. you might think that this would be more property crimes and low- leveled crimes. that is not the case. there are evidence-based programmings going on here. you need to look at the data. and there are even lower rates of property crime and do they have any other changes that have accompanied this? such as, you know, the mandatory reviews for them. and the treatments like you have to go on in or do they

have followups. do they have more money involved in followups. do they have more probation for them to keep an eye out on people? >> that's what you will have with the savings. now, keep in mind, 1,000 murderers will go unsolved in california for the lack of funds to invest that there and more police on the streets. now, we are wasting a lot of money. we are putting the felony conviction on someone and it does not lower the drug rates. >> the final question when yo do these cost savings, does it guarantee you with the money and where you said it would be going, rather than taking the money to save it and put it. some place else? >> the follow up. sure. there will be savings that you can write it to direct it to local law enforcement and they would be smart to use it in that way because they know they will get better results. >> okay, well, we'll need to keep an eye on that. it will be a very busy week up in sacramento. >> yes, differently. >> okay, we're out of time for this segment. stay tuned because we've got a

tuesday. can you believe it, it is here already. all four candidates are trying to come up with something for the camera. >> sometimes it backfires. mitt romney and rick santorum seem to be out of the race. but now we talked to a couple of people who are no strangers to having misspoke in their careers and we asked them about the pluses and minuses and how to handle those. the former mayor willie brown. now, any advice for these guys? >> don't worry about being misquoted. just hope that you are quoted. [ laughter ] i'm appreciating that as lieutenant governor. i think that is a great emphasis. i never felt like that as mayor, but boy right now, i appreciate it. >> it is interesting to see it and to see these guys on out there with the camera on them all the time. they can't seem to deliver something without a glove. but you've got a problem. they have no ability to be on out there. >> yeah. >> i mean, he literally has to

have a teleprompter to say hello. on the other hand, rick santorum, he really believes that there, which makes him as i said, kind of a misfit in the delivery. so this is a guy who doesn't open his mouth about the kennedy speech of almost 50 years ago, then he wins michigan by four to five points. >> okay, but what are you doing when you're standing in front of those cameras and you're up at the podium. it's coming at you constantly like that. you know that every one of those lenses will not be interested in 99% of what you say that it will never air. they are looking for that there. >> of course. well, that's the game. and that is the challenge for them and that point and that romney lacks any empathy. and authenticity. you're right about santorum. the problem is that he is so darn preachful and so sure of himself. but it is remarkable for a guy that is just learning as romney and someone that has focused on the presidential aspiration for as long as they have that they

have not developed a wrath of empathy. that he is not able to connect when he talks to his father and once that primary is over, once the convention hits that peak and you know, a very close race and people will be focusing on something that is very different. i think that they will work through these things and democrats will be a little too exuberant that none of these guys will have a chance on the general that they are overstating things. >> the real authentic guy in that whole group is ron paul. >> no doubt. >> and he is really at his charm here. that is the attractiveness about him. because you know, he is not, well, he cannot disguise anything. >> yeah. >> not a thing. >> well, you know that whole political adage, sincerity. once you can take that, you will gate there. >> i think that he has a point on that. >> okay. >> following this broadcast. they will continue on their cw network that we are following the clean up and the search for survivors, following the massive storm systems of the tornadoes in the midwest and

for you. it is already here. things are pretty tight. >> that's right. we'll have the chairman here of the republican party here. but meanwhile in the news, the top of the stories. a search for survivors is continuing today after a string of tornadoes for them hitting the south in the midwest. >> a number of people killed right now in these storms has climbed to nearly 40 people in five states. now, here are the tornadoes, rob live rating the town in harriesville, indiana. one of them rated an ef4 and packing winds of get this, 175 miles per hour. now, that is cleaning up, it might be overwhelming for you. >> i'm here to do everything that i can to get what is important to us, what's important to me because these are awesome memory. >> and a nearly 2-year-old girl was found alive, but all of her immediate relatives died.

we are also getting word now on the updated figure of the number of people dead here is 36. that could certainly -- certainly climb as they will be continuing to search through the rubble in these states. >> well, on the national front in other political news, tuesday is super tuesday and it is just two days away. most of them spent yesterday campaigning in that delegate rich state of ohio. meanwhile washington state, they have held their caucuses. they were on yesterday and mitt romney racked up another victory there. >> reporter: inside some caucus sites, it was standing-room only. in others, voters were turned away, as tens of thousands of washington state republicans made their picks for the presidential nominee. mitt romney won the contest.

ron paul dropped in on the caucus goers on saturday. pushing hard for their first victory. but he came up short. the washington state win, it might give romney a boost heading into the critical super tuesday contest. and on saturday, he rallied the supporters in ohio, where he was locked in a close race with rick santorum, but he stuck to hammering president obama and highlighting his business background. >> with jobs so badly needed, with the incomes having gone down, we need a president who knows that economy to fix the economy. >> reporter: santorum used a 2009 u.s.a. today editorial to challenge romney on health care. in it he said he supported the individual mandates and tax penalties that inspired their health care bill. >> and you know it is bad enough that he recommended that. it is worse that he would not come clean with the primaries. >> reporter: speaking near cincinnati, he said although that he is counting on a win in georgia, the state he represented for 20 years, he feels like he will do well if

many ohio. we'll see more opportunities here. they will be up for grabs. drew drew, bay area news. >> reporter: she used her time in the house. pairing that up there about the georgetown law student. he fired off those harsh words after the student testified before congress. and over insurance here for them and the birth control. >> shame on you. shame on you for being the hate monitor that you are. shame on you for being on out there. that's what he did. >> now this weekend, he apologized to that law student after some advertisers pulled from out of the radio show. he intended he did not mean to have that there. and in a website, he said that the choice of words were not the best in attempt to be

humorous by creating the national stir. i sincerely apologize for the insulting word choices. >> okay, now for the local news. the oakland police chief has reassigned nearly half of the community police officers here to support mayor jean's block plan. now as a result, 22 solving officers who were a part of the crime fighting teams are focusing on the city's most violent neighborhoods are being placed there from the other parts of the city. >> that is being assigned here and they are the officers that were able to come back to work for the city last july when the police officers union agreed to pay into the pension. we were able to bring back an extra 34 officers. >> the officer's salaries are funded by the measure here, obvious. and that will be approved by the voters eight years ago. the money also supports the

other crime prevention programs. and speaking of the crime prevention. a money saving transfer went into effect this morning in one peninsula city. the san mateo county sheriff's office is taking over the police department. the city's 14 sworn officers, they will serve the same year, but they will be partnered with the sheriff employees. the move to contract the services, they will save them an estimated $1.6 million in the first year. >> it is the next step in the largest animal rescue operation in california history. thousands of malnourished hens were rescued in the county here and they are nursing them back to health. we'll show you how you can help in the road to recovery. 2000 hens that lived in battery cages for a little over a year. >> reporter: he said that they were starved for weeks and unable to move. those were the conditions that 50,000 hens endured. >> it is real sad, you know. it is a terrible situation for

them. >> 40,000 hens did not survive, but the majority of the animals who did, they are now being cared for here at the animal place rescue ranch. since arriving earlier this week, they received medical attention and a diet of a high- protein, high cal yum feed. they are scratching, running around. >> reporter: but getting back to good health has not been easy. >> it's been on out there every single day with it. the army of volunteers. >> not only physically, but draining as well. they will go through 2,000 pounds or 400 dollars worth of that per day. >> you want to have a backyard. you need to be able to protect them from the predators and then have access to, well, you

at a jobs fair yesterday... the city departments looking for help included parks and rec... and the explorer programs in the fire and police departments. the city wants to gi

jobs to people wh including that program here for them in the police and the fire department. now, the city wants to give at least half of the 1,000 jobs available to people that live in the high-crime neighborhoods. that's a part of the mayor's 100-block initiative. >> you can't, but you know, you cannot see the kids that are dealing with the drugs on the corner. i would have conversations to them. they would say to me, ma'am, if i did not have a job, i would not do that. i actually believe a lot of those kids. >> last year, congress cut a summer job's program. so they have been filling the gap in the combined private effort for them to create around about 1,000 summer jobs. they will have another job fair coming up in april. >> okay, is summer here now? >> it sure feels like it, doesn't it? we'll see the temperatures warming up here in the bay area again. taking a live look outside right now. it really feels like spring on out there. and the winds, that's when we will see a cool down and some snow in today's pinpoint

break it state? >> yeah, i think it is. that will be in february. i don't know why you are saying that it will be here so quick. four years ago he won nine of the states, romney 7. then it became clear for a lot of people that he was going to be the nominee, he started to wrack up the victories. so if he wins six states or seven states on tuesday, then it will be hard for the others to have that there and how to get to the top. >> do you think that's going to happen. do you think we will have that answer? >> well, i think that he will win six states. santorum is in virginia, which is a big state. >> the definition of win. and you are the winner. that's what we are having here is that it splits. and that tells you that 60% of

the republican faithful, they are not on out there with the guy. and they want to rack that up if they are not solved. >> he did not get above 40% into march well into super tuesday and people asked that question pack then. it's not a good thing that there is not a consolidation. however, he is kicking up at this 40% earlier than mccain did in the sense of the numbers of the primaries. that's just the way it is. i expect them to calm it down. you have a secretary of energy saying they want to see the gas prices. the republicans, they obviously don't. so you know it is going to be a clear difference for you and i expect the republicans to rally for them when, you know, the issue becomes, well, one energy policy verses the other. >> i'm hoping that you guys are hoping that it will be wrapped up soon because of all the insiding. it doesn't look good. it's bringing up all these negatives that will be used later on in the campaign.

>> yeah, absolutely. you are 1 is 00% right. now, realize though that this is good for obama at this point because in the battleground states, they are basically even. this is the low point for the republicans. and once it becomes, you know, the republican verses the democrats, then you can start drawing the differences in the independence and they will see one as an energy policy, one doesn't. >> okay, but so far this race has been negative. and that will be the attack for each other. >> what one isn't negative though? well, hold on. whoever the perceived front runner is, they are running against, correct? they are also running against obama on the other side. is that one of the reasons why he has not connected with them because they are not saying that. they will be saying what they are opposed to or why they should not get it including the president themselves. but what are they bringing the table? are they articulating that? >> that is the difference for them and the democrats on the democrats will intend to be

transfor wall street is buzzing over the latest company to go public. yelp is transforming the ordinary companies into the viral online reviewers. and the ticket to the stock exchange. >> the company saw their stock prices jump about 73% in the first day of trading. but a question that we asked our cree way fors, it will come to the economy locally. are these things a boom or a bust? here is what the lieutenant governor had to say about that. >> you think of twitter and yelp and facebook and all these companies that are getting so much attention. huge market cuts. and so that is the reality of

it that this is just wonderful in terms of wealth making, but not necessarily a significant view as some might believe in terms of job creation. >> and you get a big boost when they will go public or something like that. but at the same time, it seems to be moving left and right for the breaks. >> the person that will write the budget, they cannot under any circumstances, allow themselves to become addicted enough to spend that money there. and you better take that money and put it into something that will be involving the infrastructure or something involving the deferred maintenance or something of that nature. you cannot add the new employees on the public sector side, based upon the income. it may not be that question. >> but no one will understand that every itation better than the former mayor that will be sitting here to use that money as they are saying, the capital gains for the ongoing purposes. but you are absolutely right. this is why you have been working with the committee and others to try to smooth out these revenue flows. >> you are writing a book on this one. >> yeah. >> is this a healthy way to be building on our economy?

>> of course it is. you need to get up into the future business. this is the eco-system to find the best, not only in this state, but this nation and we still need to compete in any country of the world. i'll tell you that they will be breeding into san francisco and it is extraordinarily powerful because, you know, it distinguishes itself from the 1990s. we have a lot of companies with no revenue and no chances of success for today when they have the revenue streams, they are harder to go to the public, so you need to have more behind you in terms of substance. so i think that this one will be more sustainable than you would have expected. >> and so one more thing. every single policy, one that has been built on the basis of the private investment, not the government investment. >> right. >> that's a good point. >> that is a dramatic weigh-in, in which you want to build your policy. >> the only thing that will slow us down are these sand in the gears of our capacity growth and that is the talent. every one of these companies, they have one complaint, one complaint exclusively that we cannot find enough qualified people for them, which will be
